RECRUITING ANNOUNCEMENT FOR A POSITION OF MEMBER IN THE MANAGEMENT BOARD OF THE NATIONAL COMPANY FOR PASSENGER RAILWAY TRANSPORT “CFR CĂLĂTORI”-S.A.
The Ministry of Transport and Infrastructure and its’ recruiting expert S.C. Pluri Consultants România S.R.L. would like to announce the start of the candidate recruiting and selection procedure, for nomination, in view of the members’ designation for the Management Board of the National Company for Passenger Railway Transport “CFR Călători”-S.A. The purpose of the recruiting and selection process is to identify, recruit and select the most suitable 7 candidates for occupying member positions in the Management Board of the National Company for Passenger Railway Transport “CFR Călători”-S.A. This recruiting and selection process takes place according to the provisions of O.U.G. no. 109/2011 regarding the corporate governance of the public undertakings, approved through Law no. 111/2016 and H.G. no. 722/2016 regarding the approval of the methodological application norms for some of the provisions of the O.U.G. no. 109/2016 regarding the corporate governance of the public undertakings, with further amendments, as well as of Regulation (EU) no. 2016/679 regarding the protection of natural persons with regard to the processing of personal data.
1. THE RECRUITING AND SELECTION PROCESS
The recruiting and selection process of the candidates for the 7 member positions in the Management Board currently in recruitment has the following phases:

All the phases are eliminatory.
The candidates shall be operatively and transparently informed, by telephone and e-mail, regarding the eventual changes performed in the deployment plan of these phases, as well as regarding the results obtained by each of them during each phase of this process.
2.CONDITIONS FOR PARTICIPATION
The candidates we wish to identify during the selection process for nomination in view of the members’ designation for the Management Board of the NATIONAL COMPANY FOR PASSENGER RAILWAY TRANSPORT “CFR CĂLĂTORI”-S.A., must cumulatively meet the following requirements:
I. Common eligibility criteria for all administrator positions:
- Must have Romanian citizenship or citizenship of other European Union Member States, under the condition of having residence in Romania;
- Must not be in a conflict of interests which would make them incompatible with exercising the position of administrator in the company’s Management Board for which they applied;
- Must not be in any of the situations listed in Article 30, paragraph 9, as well as in Article 39, paragraph 7, of O.U.G. 109/2011;
- Must not have been condemned definitively by decision of court for committing crimes against humanity, against the state or against authority, corruption of service crimes, crimes against the application of justice, crimes of forgery, crimes against patrimony, for crimes listed in Law no. 656/2002 regarding the prevention and punishment for money laundry, as well as the enforcement of measures for preventing and fighting against terrorism financing, with further amendments, or for crimes listed in Law no. 85/2014 regarding the procedures undertaken with intent which would make the candidate incompatible with the exercise of the position;
- Must not have performed political police, as defined by law;
- Must have full exercise capacity;
- Must be medically fit;
- Must meet the criteria required by O.U.G. no. 109/2011 regarding the corporate governance of public undertakings, approved with amendments through Law no. 111/2016 and H.G. no. 722/2016;
- Must not exercise simultaneously more than 3 administrator and/or member in the supervisory board mandates, in public companies or undertakings, according to Article 33 of O.U.G. no. 109/2011;
- There cannot be more than 2 members from the public servants or other staff categories of the tutelary public authority, or from other public authorities or institutions.
- Persons which are incompatible according to Article 7, paragraph (7), of Law. no. 202/2016 regarding the integration of the Romanian railway system in the single European railway area, cannot be administrators.
II.Specific eligibility criteria
A. For the administrator positions with qualifications other than economic or judicial
- Must have at least 5 years in the field of work;
- Must have at least 5 years of experience in administration, leadership, management or coordination in public or private entities;
- Must have at least 5 previous years of experience in management, administration, control or regulation in entities from the main activity area of the undertaking;
- Must be graduates of upper study programs (ISCED 6 equivalent), finalized with diploma, in an upper educational institution;
B.For the administrator positions with economic or judicial qualifications
- Must have at least 5 years in the field of work;
- Must have at least 5 years in the field of work and at least 5 years of professional experience specific to the field of the graduated economic or judicial studies;
- Must have at least 5 years of experience in administration, leadership, management or coordination in public or private entities;
- According to the provisions of Article 65, paragraph (3) of Law no. 162/2017, at least one member of the audit committee must have competencies in accountancy and statutory audit, verified through qualification documents for the respective fields.
3.SUBMITION OF THE APPLICATIONS
The applications shall be submitted until the 29th of September 2022 at the latest, on paper support, in a closed and sealed envelope, on which the following text shall be mentioned: „Application for the Management Board of the NATIONAL COMPANY FOR RAILWAY PASSENGER TRANSPORT „CFR CĂLĂTORI”-S.A. / Surname and first name of the candidate”, at the headquarters of S.C. Pluri Consultants România S.R.L., situated on 164A Barbu Văcărescu street, CARO Hotel, zip code 020285, District 2, Bucharest. The application must be also sent in electronic format at the 109@pluri.ro e-mail address. The applications on paper support can be submitted in person or can be sent by mail or courier at the above mentioned address. The application submission e-mail messages, as well as the annexed documents, shall have to include mandatory the surname and first name of the candidate, as well as the name of the undertaking (ex. „MB Application CFR CALATORI Surname_First Name”, namely „CV Surname_First Name CFR CALATORI”).
4.NECESSARY DOCUMENTS FOR THE SUBMISSION OF APPLICATIONS
Dosarele de candidatură vor conţine în mod obligatoriu următoarele documente:
- List of documents
- Curriculum vitae, according to the common European template;
- Medical certificate;
- Judicial record;
- Fiscal record
- Copies of:
- Identity document;
- Marriage certificate or other documents, only if the name on the submitted documents differs from the one on the identity document;
- Licence diploma or equivalent;
- Documents which prove the required professional experience (mandatory extract from Reges / Revisal and work license, mandate / management contracts, certificates issued by employers etc.)
g. Forms:
- F1 – Application for registration
- F2 – Affidavit regarding the conformity of the documents and information presented in the application, lack of the conflict of interests and of situations of incompatibility;
- F3 – Agreement for obtaining data in order to verify the information;
- F4 – Consent for personal data processing;
- F5 – Declaration of interests.

If any of the above mentioned documents is missing and the candidate does not send it in due time, the application shall be rejected.
5. SELECTION CRITERIA
The competencies of the candidates and their behavioural features shall be evaluated, firstly in the initial selection phase and then in the final selection one. The main selection criteria used in these 2 phases are:

6. OTHER INFORMATION
a. Communication with the candidates
During this entire selection process, communication with the candidates shall be performed via e-mail and telephone, which is why it is imperatively necessary that the e-mail address and telephone number mentioned in the CV to be correct.
The long list, short list and nomination proposals are confidential and shall not be published; the results obtained by the candidates during each of the phases of the selection process shall be communicated to them individually via the above mentioned means.
b. Complaints
The corporate governance legislation for public enterprises does provide for complaints. Still, wishing to ensure maximum transparency of the recruitment and selection process, we shall promptly answer to the clarification requests formulated by the candidates, under the condition that they request only information referring to their application and which do not involve the results obtained by the other candidates. The eventual clarification requests shall be submitted in the same manner as the applications or declarations of intent, specifying on the envelope „Clarification request regarding the results of the (application evaluation, initial selection or final selection) phase CFR CĂLĂTORI_Surname First name), while the document sent via e-mail shall be saved with the „Clarification request Surname First name” title.
Clarification requests shall be submitted in maximum 24 hours from receiving the results and shall be answered to in the same term of maximum 24 hours from the registration of the request.
c. Personal data protection
This recruitment and selection process described above in detail, shall take place according to Regulation (EU) 2016/679 on the protection of natural persons with regard to the personal data processing. In this regard, we shall respect the following:
- All the candidates shall give their consent regarding personal data processing
- All personal data supplied by the candidates shall be used only by the expert or the representatives of the Ministry of Transport and Infrastructure, in order to select the most competent and motivated candidate the position of member in the Management Board
- All the personal data supplied by the candidates shall be deleted one year after the nomination date
- As long as the candidates’ personal data are in our possession, no information shall be made available to any other party, according to the in-force legal provisions.
- Should they wish it, the candidates may request at any time information regarding the way in which their personal data are stored and used
- At any moment when a candidate decides to withdraw from this recruitment and selection process, we shall make sure that his personal data shall be deleted from our data base, according to the in-force legal provision in this field.
